Privacy Policy

Effective October 18, 2026

This policy explains how the Law Office of Madaen ("the firm", "we") collects, uses, protects and shares personal information through toppaymaster.com, including the client portal. It is provided under the California Online Privacy Protection Act (Business and Professions Code section 22575 and following). Information you give the firm as a client is also protected by the attorney's duty of confidentiality (Business and Professions Code section 6068(e)).

Information we collect

  • Contact form: your name, email address, telephone number and message.
  • Client account: your name, email address and password (stored only as a secure one-way hash), and two-step sign in settings.
  • Client Information Sheet: identity details (name, date of birth, citizenship, address, telephone, identification document details), company and ownership details, transaction details, source of funds, bank details for payment, and answers about political exposure and sanctions.
  • Documents you upload: such as identification, IRS forms, company records and contracts.
  • Electronic signatures: your typed name, drawn signature, the date and time, IP address and browser.
  • Technical information: IP address, browser type and pages visited, recorded in server logs for security. If analytics is enabled, Google Analytics collects similar usage information through cookies.

How we use it

  • to answer your inquiry and decide whether the firm can help;
  • to represent you and carry out the Paymaster Agreement;
  • to verify identity and screen parties against U.S. sanctions lists, as the law and the firm's bank require;
  • to meet legal, tax, professional and record keeping obligations;
  • to protect the website and its users against fraud and unauthorized access.

We do not sell or rent personal information, and we do not use it for advertising.

Who we share it with

  • the firm's bank, to the extent needed to receive and send funds and for the bank's legal compliance checks;
  • government authorities, when the law requires, such as tax reporting or a valid legal order;
  • service providers that help operate the website and email (web hosting and email providers), who may process data only to provide their service;
  • other parties to your transaction, only as needed to carry out your signed instructions or with your permission.

How we protect it

The firm uses reasonable security measures appropriate to the nature of the information (Civil Code section 1798.81.5), including: encrypted connections (HTTPS) for the whole site; a confirmed email, a strong password and two-step sign in with an authenticator app for every client account; account lockout after repeated wrong passwords; encryption of questionnaire answers and uploaded files on the server; storage of files outside the public website; access to client records limited to the attorney; and a log of sign ins, uploads, downloads and signatures. No system is completely secure; please protect your password and authenticator device and tell the firm promptly if you suspect misuse.

Cookies

The site uses strictly necessary cookies to keep you signed in and to protect forms against forgery. If Google Analytics is enabled, it uses cookies to measure visits to public pages (never the client portal). You can block cookies in your browser; the client portal will not work without the necessary cookies.

Do Not Track

Browsers can send a "Do Not Track" signal. There is no common standard for responding to it, and this website does not change its behavior when it receives one. Other than Google Analytics on public pages when enabled, the firm does not allow third parties to collect information about your online activities over time and across other websites through this site.

How long we keep it

Client and trust account records are kept for the periods required by the California Rules of Professional Conduct, tax law and the firm's other legal obligations, generally at least five years after the engagement ends. Contact messages that do not lead to an engagement are kept only as long as needed.

Reviewing and correcting your information

Clients can review their questionnaire answers and documents in the portal. To correct or update information, or to ask about deleting information the firm is not required to keep, write to attorneymadaen@gmail.com or call (714) 782-7275. California residents may also have rights under the California Consumer Privacy Act where it applies.

Children

The site is not directed to anyone under 18, and the firm does not knowingly collect information from minors.

Changes to this policy

If this policy changes, the new version is posted on this page with a new effective date. Material changes are also shown on the home page or sent to clients by email.
